Marlow County Sheriff's OfficeOffice of the Sheriff

To whoever is in charge,

I've been in law enforcement thirty-one years. I know what a search is, and tracking a man's every movement without a warrant is a search.

My county vehicle has been logged going to my hunting cabin, my church, my doctor and my daughter's house. None of that is evidence of a crime. None of it was authorized by a judge. This is a Fourth Amendment violation, plain and simple, and I'm putting you on notice.

I want the records destroyed and the vehicle removed from your system.

Dear Sheriff Kemper,

Thank you for your letter and for thirty-one years of service. We take constitutional questions seriously, so we asked our counsel to look at this closely before writing back.

Counsel's view is that the vehicle is county property traveling on public roads, where anyone can see it. Public assets don't have Fourth Amendment rights. They have maintenance schedules. Nothing about where the vehicle goes is private, because a public road is public.

Counsel also pointed out that this is the same reasoning the Marlow County Sheriff's Office used in its own reader policy in 2019, which you signed. That policy put readers on fourteen county roads without warrants, on the grounds that driving in public carries no expectation of privacy. Counsel found it very persuasive and said it was well written.

Since your policy is still in effect, we've enrolled your personal truck under it. It was seen at the cabin, the church and your daughter's house too, so this way the record is complete. We've attached a copy of the policy for you.

Warmly,

Dana WhitcombDana Whitcomb
